Terms of Service

Welcome to WISHLane. By accessing or using our platform at wishlane.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the platform. These Terms apply to all visitors, registered users, wish creators, and donors.

1. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account, publish a wish, or make a donation.
• By using WISHLane you represent that you meet this requirement and that all information you provide is accurate and truthful.

2. Account Registration

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must notify us immediately at support@wishlane.com if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Wish Creation and Content

• Wishes must represent genuine personal needs or goals. Fraudulent, misleading, or deceptive wishes are strictly prohibited.
• You are solely responsible for all content (text, images, videos) you post. Content must not be illegal, harmful, defamatory, obscene, or infringing on any third-party intellectual property rights.
• We reserve the right to remove any wish or content that violates these Terms, at our sole discretion and without prior notice.
• By posting content on WISHLane, you grant us a non-exclusive, royalty-free, worldwide license to display and promote that content in connection with the platform.

4. Prohibited Campaigns

• To keep the platform safe and to comply with our payment provider's requirements, the following campaigns are strictly prohibited and will be removed:
• Weapons, ammunition, or explosives; illegal drugs, controlled substances, or drug paraphernalia; tobacco, e-cigarettes, alcohol, or prescription/pharmaceutical products.
• Adult or sexually explicit content, products, or services; gambling, lotteries, raffles, or games of chance.
• Investment, securities, lending, cryptocurrency, or any "get-rich-quick," pyramid, or multi-level-marketing scheme; debt collection or credit repair.
• Hate speech, harassment, or content that promotes or funds violence, terrorism, or discrimination against any group or individual; bail or the legal defense of violent crimes.
• Counterfeit, stolen, or unlawfully obtained goods; regulated or restricted products or services; any campaign that is false, misleading, or that we determine violates our payment provider's restricted-business rules or applicable law.
• We may remove any campaign and suspend any account for a suspected violation, and may report unlawful activity to the appropriate authorities.

5. Donations and Payments

• All donations are voluntary. WISHLane does not guarantee that a wish will reach its goal or that funds will be used as described by the wish creator.
• WISHLane is a technology platform that facilitates contributions. It is not a bank, money transmitter, money services business, charity, or escrow agent, and it is not a party to the transaction between a donor and a creator. All payments are processed by our third-party payment provider, Stripe.
• Donations made through WISHLane are personal gifts to the wish creator, not charitable contributions. WISHLane is not a registered nonprofit or 501(c)(3) organization, and donations — including to wishes tagged "Charity" — are generally not tax-deductible. Consult a tax professional regarding your specific situation.
• Donations are processed by Stripe. By making a donation, you agree to Stripe's Terms of Service.
• Funds intended for a creator are held only temporarily and are released to the creator once they complete identity verification and connect a payout account through Stripe. Contributions above a set threshold are held for manual review before release.
• We use automated monitoring to detect suspicious contribution patterns (for example, unusual velocity or repeated amounts designed to avoid review) before funds are released. This monitoring does not extend to how a creator spends funds after they are disbursed — WISHLane does not audit, verify, or track the use of funds once they reach a creator's connected payout account.
• Donations are generally non-refundable. If you believe a wish is fraudulent, please contact us immediately.
• WISHLane may charge a platform fee on donations. Any applicable fee will be disclosed before you complete a transaction.

6. Gift Registry (Gift an Item)

• Wish creators may add specific items to their wish registry. Donors who purchase a registry item pay via Stripe and WISHLane marks the item as fulfilled.
• WISHLane does not purchase, hold, or ship any physical item. Payment for a registry item is transferred to the wish creator in the same manner as a donation (see Section 5) — as cash to the creator's connected payout account, or held on the same terms if they are not yet connected. The creator is solely responsible for purchasing and obtaining the item themselves.
• As an alternative, a donor may choose to purchase an item directly from a third-party retailer and ship it to the creator without any payment passing through WISHLane.

7. Prohibited Conduct

• You agree not to: use the platform for illegal purposes; impersonate any person or entity; upload malware or malicious code; scrape or harvest data without permission; interfere with the platform's security or infrastructure; post spam or unsolicited commercial messages.
• Violation of these prohibitions may result in immediate termination of your account and, where applicable, legal action.

8. Intellectual Property

• The WISHLane name, logo, and all platform code are the property of WISHLane and its licensors. Nothing in these Terms grants you a right to use our trademarks, trade names, or logos.
• You retain ownership of original content you post. You are responsible for ensuring you have the rights to any content you upload.

9. Disclaimers

• WISHLane is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that the platform will be uninterrupted, error-free, or free of viruses.
• We are not responsible for the conduct of wish creators, donors, or any third parties.

10. Limitation of Liability

• To the fullest extent permitted by law, WISHLane and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform.
• Our total liability to you for any claim shall not exceed the greater of $100 or the amount you paid to WISHLane in the 12 months preceding the claim.

11. Indemnification

• You agree to indemnify and hold harmless WISHLane and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorney fees) arising out of your use of the platform, your content, or your violation of these Terms.

12. Termination

• We may suspend or terminate your access to WISHLane at any time, with or without cause, and with or without notice.
• Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including Sections 8, 9, 10, and 11) will remain in effect.

13. Governing Law

• These Terms are governed by the laws of the jurisdiction in which WISHLane is registered, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.

14. Changes to These Terms

• We may revise these Terms at any time. We will provide at least 14 days' notice of material changes via email or a prominent notice on the platform. Continued use after changes take effect constitutes acceptance.
